NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS SWEEPSTAKES. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.
DATES OF THE SWEEPSTAKES: The “$50,000 Giving Thanks” Sweepstakes (the “Sweepstakes”) begins at 12:00 AM (Eastern Standard Time [“EST”]) on December 30, 2019 and ends at 11:59 PM EST on April 26, 2020 (the “Sweepstakes Period”). The Sweepstakes Period will consist of seventeen (17) entry periods (each, an “Entry Period”) as outlined in the “ENTRY PERIODS” section of these Official Rules.
ELIGIBILITY: To enter the Sweepstakes, you must be a lawful permanent resident in one (1) of the fifty (50) United States or the District of Columbia (excluding Vermont, Puerto Rico and the U.S. territories and possessions) and at least the age of majority in your state of residence (nineteen (19) in Alabama and Nebraska, twenty-one (21) in Mississippi, and eighteen (18) in all other states) with a valid Social Security number at the time of entry (the “Entrant”). Employees of Green Dot Corporation (the “Sponsor”) and each of its affiliated companies, parents, subsidiaries, and advertising and promotion agencies, including, but not limited to National Sweepstakes Company, LLC (the “Sweepstakes Administrator”), herein (collectively, “Sweepstakes Entities”), and any service partners, as well as The Bancorp Bank, MetaBank®, Mastercard International Inc. and Visa U.S.A. Inc. (collectively, the “Releasees”) and their immediate families (i.e., parents, children, siblings, spouse) and members of their households (whether related or not) are ineligible to participate in this Sweepstakes. Sweepstakes is void in Vermont, Puerto Rico, U.S. territories and possessions, outside of the fifty (50) United States and the District of Columbia and where restricted or prohibited by law. By entering, Entrants agree to be bound by these Official Rules, including all eligibility requirements and the decisions of the Sponsor, which are final and binding.
ENTRY PERIODS: For the purposes of this Sweepstakes, there will be a total of thirteen (13) Entry Period drawings (each an “Entry Period drawing”) and four (4) monthly grand prize drawings (each a “Monthly Grand Prize drawing”). There will be thirteen (13) entry period prize winners (each an “Entry Period Prize Winner”) and four (4) monthly grand prize winners (each a “Monthly Grand Prize Winner”) of the Sweepstakes. Entry Period Prize Winners will NOT be selected in an Entry Period drawing when there is a Monthly Grand Prize drawing.
Each Entry Period will start on Monday of each week during the Sweepstakes Period at 12:00 AM EST and end on the following Sunday at 11:59 PM EST. For example, Entry Period 1 will start at 12:00 AM EST on December 30, 2019 and end at 11:59 PM EST on January 5, 2020. All entries submitted during Entry Period 1 will be eligible for the Entry Period 1 drawing. All entries submitted during Entry Period 2 will be eligible for the Entry Period 2 drawing, so on and so forth until Entry Period 4 in which all entries submitted during Entry Periods 1 to 4 will be eligible for the first Monthly Grand Prize drawing for Entry Period 4. All entries submitted during Entry Periods 5 to 8 will be eligible for the second Monthly Grand Prize drawing. All entries submitted during Entry Periods 9 to 12 will be eligible for the third Monthly Grand Prize drawing. All entries submitted during Entry Periods 13 to 17 will be eligible for the fourth Monthly Grand Prize drawing. NOTE: Entry Period Prize Winners will NOT be selected on Monthly Grand Prize drawing dates. All prize winners, whether Entry Period Prize Winners or Monthly Grand Prize Winners, will be announced on the Thursday following the respective Entry Period. If the prize winner is disqualified, the Sponsor will have no obligation to fulfill such prize even if the prize winner’s name may have been publicly announced. See the Entry Period Chart at the end of these Official Rules for details and dates about each Entry Period and monthly Grand Prize drawings.
ENTRIES FROM THE PREVIOUS ENTRY PERIOD(S) WILL NOT CARRY OVER TO SUBSEQUENT ENTRY PERIOD DRAWINGS OR MONTHLY GRAND PRIZE DRAWINGS.
HOW TO ENTER: There are three (3) ways to receive entries into the Sweepstakes. Regardless of the method of entry, there is a limit of two thousand (2,000) entries per Entrant per Entry Period, unless bonus entries are eligible to be received during an Entry Period, there is a limit of four thousand (4,000) entries per Entrant for such Entry Period.
1. Load or Purchase Entry: Make a qualifying load or purchase using your personal card account with any of the following cards: AccountNow Gold, AccountNow Gold Visa® Prepaid Card, AccountNow Prepaid Visa Card or AccountNow Prepaid Mastercard®, Prepaid Visa RushCard, Green Dot Unlimited Cash Back Bank Account Visa card, Green Dot branded reloadable Prepaid Visa or Green Dot branded reloadable Prepaid Mastercard cards (not inclusive of Green Dot Load & Go Prepaid Card), Green Dot 5% Cash Back Visa Debit Card, Halogen Prepaid Mastercard, NASCAR Reloadable Prepaid Visa Card, Uber Visa Debit Card from GoBank, GoBank branded Mastercard or GoBank branded Visa Debit cards, 1199SEIU prepaid card, SEIU prepaid card, One Main Prepaid Visa card, Turbo Prepaid Visa card, Turbo Visa Debit card, TaxSlayer Prepaid or Debit Visa card, or AchieveCard Visa Prepaid card (each, a “Card”) and receive one hundred (100) entries for such qualifying load or purchase transaction. The One Main Prepaid card may only be obtained from a One Main location. Qualifying loads include: direct load, cash load/reload at retail locations, MoneyPak, Mobile Check load, and bank transfers. Western Union/MoneyGram for RushCards only. Non-qualifying loads and purchases include Peer-to-Peer transfers, ATM withdrawals and Vault transfers. Qualifying purchases include signature purchases, PIN purchases, and Bill Pay. Paypal transfers are not eligible for this Sweepstakes.
IMPORTANT: Entrant must have a verified Card in order to enter using a Card. A qualifying load or purchase is dependent upon the date on which the qualifying load or purchase is posted to the Card account. In order to qualify as an entry, the eligible load or purchase must post to the Card account by 11:59 PM EST on the last date of the applicable Entry Period or by April 26, 2020, the close of the Sweepstakes Period. There is no minimum value requirement; the value of the load(s) or purchase(s) will not increase or decrease the chances of winning a prize.
3. TO ENTER WITHOUT A CARD: E-mail Entry: To enter without having or using an eligible Card or making a load or purchase, send an email message to firstname.lastname@example.org, including your first name, last name, address, city, state, ZIP Code, daytime telephone number, date of birth, and email address. Be sure to include the following in the subject line of the email message: “$50,000 Giving Thanks, [ENTRY PERIOD START AND END DATES]. For example the subject line of the email message for Entry Period 1 would be as follows: $50,000 Giving Thanks, December 30 to January 5. Make sure to change the start and end dates on the subject line when entering a different Entry Period. See Entry Period Chart at the end of these Official Rules for the start and end dates for each Entry Period. The start and end dates specified in the subject line of an email must be consistent with these Official Rules and the email message must be sent during the applicable Entry Period to be considered eligible. Each email received from an Entrant that correctly follows the instructions outlined above during an Entry Period will result in forty (40) entries into that respective Entry Period drawing. Entrant must submit separate emails in order to receive multiple entries within an Entry Period. In order to qualify as an entry, the eligible email must be received by 11:59 PM EST on the last date of the applicable Entry Period. Emails sent for Entry Periods that are yet to begin or Entry Periods that have ended will be disqualified.
Limit of two thousand (2,000) entries per Entrant for each Entry Period, regardless of method of entry, unless bonus entries are eligible to be received during an Entry Period, then there is a limit of four thousand (4,000) entries per Entrant for such Entry Period. Entries received from any Entrant or Eligible Card in excess of the above stated limitation will be void.
In the event of uncertainty as to the identity of an Entrant, that Entrant will be disqualified. Any attempt by any Entrant to obtain more than the stated number of entries by using multiple/different identities, Cards, email addresses, accounts, and/or any other methods will void that Entrant’s entries and that Entrant may be disqualified from the Sweepstakes. No mechanically or programmatically reproduced entries are permitted. Sponsor will not verify receipt of entries for Entrants. All entries submitted become the sole property of Sponsor and will not be returned. Sponsor is not responsible for lost, late, misdirected, illegible or damaged entries, loads or failed internet connections.
RANDOM DRAWINGS/ODDS OF WINNING: Entry Period Drawings/Odds: On or about the Entry Period drawing dates contained in the Entry Period Chart at the end of these Official Rules, one (1) Entry Period Prize Winner will be selected in a random drawing for each Entry Period (excluding Entry Periods 4, 8, 12 and 17) to be conducted under the supervision of the Sweepstakes Administrator, an independent judging organization, whose decisions are based on their sole discretion and interpretation of these Official Rules, and are final and binding in all respects. Entries from the previous Entry Period drawings will not carry over to subsequent Entry Period drawings. Odds of winning an Entry Period Prize (as defined in the “PRIZES” section below) depend upon the total number of eligible entries received during the respective Entry Period.
Monthly Grand Prize Drawing/Odds: On or about the Monthly Grand Prize drawing dates contained in the Entry Period Chart at the end of these Official Rules, one (1) Monthly Grand Prize Winner will be selected in a random drawing from among all eligible entries received throughout the applicable Entry Periods, conducted under the supervision of the Sweepstakes Administrator, an independent judging organization, whose decisions are based on their sole discretion and interpretation of these Official Rules, and are final and binding in all respects. All eligible entries from all Entry Periods will be eligible for the respective Monthly Grand Prize drawing. Odds of winning a Monthly Grand Prize (as defined in the “PRIZES” section below) depend upon the total number of eligible entries received throughout the applicable Entry Periods.
PRIZES: Entry Period Prizes (13): One (1) prize of $1,000 to be awarded as either a credit or a check to the Entry Period Prize Winner per Entry Period (each an “Entry Period Prize”). If an Entry Period Prize Winner has an open Card, the Entry Period Prize will be credited to his/her Card. If the Entry Period Prize Winner does not have an open Card the Entry Period Prize will be awarded in the form of a check. Total approximate retail value (“ARV”) of each Entry Period Prize is $1,000. Total ARV all Entry Period Prizes is $13,000.
Monthly Grand Prize (4): One (1) prize of $50,000 to be awarded in the form of a check to each Monthly Grand Prize Winner (each a “Monthly Grand Prize”). Sponsor will withhold 30% of the Monthly Grand Prize and will remit $15,000 to the U.S. Internal Revenue Service (“IRS”). Grand Prize Winner will receive a check in the amount of $35,000. Grand Prize Winner will be responsible for any additional taxes due beyond the $15,000. Grand Prize Winner will also be responsible for expenses for handling the tax filings of the Grand Prize. Total ARV of each Monthly Grand Prize is $50,000. Total ARV of all Monthly Grand Prizes is $200,000.
Total ARV of all prizes to be awarded is $213,000.
PRIZE RESTRICTIONS: There is a limit of one (1) Entry Period Prize and one (1) Monthly Grand Prize per Entrant/household. The amount of the Entry Period Prize that, if loaded to an Entry Period Prize Winner’s Card, would cause an Entry Period Prize Winner’s Card balance to exceed the Card’s maximum balance limit, the remaining amount will be awarded in the form of a check. No prize substitution, except at Sponsor’s sole discretion or as otherwise provided herein. Prizes are not transferable prior to award. All federal, state and local taxes on any prize are the sole responsibility of the prize winner and are not transferable. The prize winners are solely responsible for all other expenses not specified herein, including but not limited to applicable taxes, Card fees, and check cashing fees.
Sponsor reserves the right to exclude from the Sweepstakes any potential prize winner who is suspected of theft, fraud, or any criminal activity related to Sponsor or its affiliates. Entries associated with fraudulent Cards or other unauthorized use of Cards and entries associated with any similar fraudulent or inappropriate activities relating to any such Cards will be void and all such Entrants may be disqualified.
NOTIFICATION/PRIZE CLAIMS: Potential prize winners will be contacted by email, mail or any other available contact source provided within five (5) business days of the drawing date by the Sponsor or Sponsor representative (“Notification”). If a prize winner cannot be contacted within five (5) business days of the first attempt to contact him/her or the prize winner does not respond to the Notification within the date and time indicated within the Notification, then that prize winner will be disqualified and an alternate prize winner will be selected through a random drawing from among all remaining eligible entries received during the respective Entry Period for Entry Period drawings or all remaining eligible entries received during the Sweepstakes Period for the Grand Prize drawing.
Except where prohibited, each potential prize winner must sign and return, within five (5) business days of receipt, an Affidavit of Eligibility/Liability/Publicity Release and an IRS W-9 Form (the “Paperwork”) in order to claim the prize. Except where prohibited by law, prize winner’s entry and acceptance of the prize constitutes permission for the Sweepstakes Entities to use said prize winner’s name, photograph, likeness, statements, biographical information and voice on a worldwide basis, and in all forms of media, in perpetuity, without further compensation. If a potential prize winner fails to return the Paperwork within five (5) business days of receipt of the Paperwork, or if an Entrant is found to be ineligible, or if he/she does not comply with the Official Rules, then the potential prize winner will be disqualified and an alternate prize winner for the applicable drawing may be selected through a random drawing by the Sweepstakes Administrator based on the prize being awarded. If a Notification or prize is returned as undeliverable, this will result in disqualification and an alternate prize winner may be selected as outlined above. The Sponsor, or a third party acting on its behalf, must report the value of the prize to the Internal Revenue Service in the year the prize is received by the prize winner and will be reported to the prize winner and the Internal Revenue Service in the form of a Form 1099. In the event it is deemed during the verification process that a potential prize winner does not have a unique, personal, and valid social security number for Sponsor (or any party acting on its behalf) to report the tax liability associated with acceptance of his/her prize, the potential prize winner will be disqualified and another potential prize winner will be selected as outlined above. Valid Social Security numbers will be determined by IRS requirements.
All prizes will be awarded within four (4) to six (6) weeks after the prize winner is confirmed. In the event that a prize is returned as undeliverable, such prize winner forfeits his/her right to the prize and an alternate prize winner will be selected from among all non-winning entries received during the respective Entry Period for Entry Period drawings or all non-winning/winning eligible entries received during the respective Entry Periods for the Monthly Grand Prize drawing.
SWEEPSTAKES RULES OF PARTICIPATION: This Sweepstakes is subject to all applicable federal, state and local laws. By participating, Entrants agree to be bound by these Official Rules and the decisions of the Sponsor and waive any right to claim ambiguity in the Sweepstakes or these Official Rules. Sweepstakes Entities are not responsible for lost, late, misdirected, undeliverable, illegible, delayed, or incomplete load or purchase posts or entries, whether due to system errors or failures, faulty transmissions or other telecommunications malfunctions, entries not received resulting from any hardware or software failures of any kind, lost or unavailable network connections, failed, incomplete or garbled computer or telephone transmissions, typographical or system errors and failures, faulty transmissions, technical malfunctions, or otherwise. Sponsor may prohibit an Entrant from participating in the Sweepstakes or winning a prize if, in its sole discretion, it determines that said Entrant is attempting to undermine the legitimate operation of the Sweepstakes by cheating, hacking, deception, or other unfair playing practices (including the use of automated quick entry programs) or intending to annoy, abuse, threaten or harass any other Entrants, Sponsor, or Sweepstakes Entities. If for any reason this Sweepstakes is not able to be conducted as planned, including, but not limited to, by reason of infection by computer virus, bugs, tampering, unauthorized intervention, fraud or any other causes beyond the reasonable control of Sponsor or the Sweepstakes Administrator which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Sweepstakes, then Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Sweepstakes and randomly draw the prize winner(s) for the Entry Period(s) that have concluded and the Grand Prize winner from the applicable eligible entries received up to the cancellation/suspension date. CAUTION: ANY ATTEMPT BY A PERSON TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY’S FEES) FROM ANY SUCH PERSON TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.
NO LIABILITY: By entering, Entrants and prize winners agree to comply with all Official Rules, as stated and agree to release, discharge, indemnify and hold harmless the Sponsor, its affiliates, and their respective agents, representatives, officers, directors, shareholders, and employees, including the aforementioned Releasees in the “ELIGIBILITY” section of these Official Rules, (now collectively defined as the “Releasees”) from any claims, actions, injury, loss or damage of any kind, including, without limitation, personal injury or death, resulting, directly or indirectly, in whole or in part, from participating in this Sweepstakes or from the acceptance, possession, or use or misuse of a prize. This limitation of liability is a comprehensive limitation of liability that applies to all damages of any kind, including, without limitation, compensatory, direct, indirect, or consequential damages; loss of data, income or profit; loss of or damage to property; and claims of third parties. Entrants agree that Releasees have not made nor are in any manner responsible or liable for any warranty, representation, or guarantee, statutory, express or implied, including, without limitation, the implied warranties of merchantability, title, and fitness for a particular purpose, in fact or in law, relative to this Sweepstakes.
CHOICE OF LAW: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of participant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the substantive laws of the State of New York, USA.
